نوازل فقهية متعلقة بشرط کون المبيع طاهرا فيما يخص الأدوية

في ظل التقدم التقني والتوسع العمراني، وتقارب المجتمعات، وسرعة المواصلات، وسهولة الاتصالات، وتنوع وسائل المعاش، وتعدد طرق اکتساب الرزق، ظهرت کثيرٌ من القضايا الفقهية التي لم تعهد في عصور التأليف الفقهي عن العلماء السابقين، کما تغيرت بعض المسائل من جهة صفاتها، ومتعلقاتها، مما يستدعي إعادة النظر فيها وفق تلک المعطيات وبيان الحکم الشرعي فيها. ومع کون الإسلام قد أحل البيع کما قال - تعالى - :﴿ وَأَحَلَّ اللهُ الْبَيْعَ وَحَرَّمَ الرِّبَا ﴾ [سورة البقرة: 275]، إلا أنه قد جعل له شروطاً لا يصح البيع دون تحققها، وهذه الشروط متنوعة، فمنها ما يتعلق بالصيغة، ومنها ما يتعلق بالمتعاقدين، ومنها ما يتعلق بالمعقود عليه، وقد بين العلماء سابقاً هذه الشروط بأدلتها وأحکامها، ولوجود بعض النوازل المعاصرة التي لم يتعرض لها العلماء سابقاً مع شدة حاجة الناس لمعرفة حکمها لزم دراستها وبيانها. وقد أحببت أن أشارک في هذا الباب ببحث أسميته (نوازل فقهية متعلقة بشرط کون المبيع طاهراً في الأدوية)، 
أهمية البحث:
    وقوع بعض المسلمين في مخالفات شرعية في البيوع المعاصرة بسبب جهلهم بحکمها. وبيان صلاحية الشريعة لکل زمان ومکان وأنَّ ما يستجدُّ من المسائل المعاصرة لا بدَّ لها من أحکام شرعية. وارتباط حاجة کثير من المسلمين بالتعامل ببعض صور البيوع في النوازل الفقهية المعاصرة.و الإسهام في إثراء الدراسات الفقهية المتعلقة بالنوازل المعاصرة. وبيان النوازل الأحکام المتعلقة بها.ولکون البحث يعرض أحکام النوازل الفقهية المعاصرة في البيوع ويربطها بأقوال الفقهاء في المسائل المشابهة لها.
أسباب اختيار البحث: الحاجة لدراسة النوازل المعاصرة لکثرتها وتنوعها. و رغبتي في البحث والمشارکة في معرفة أحکام النوازل الفقهية المعاصرة، وخاصة ما يتعلق بشروط المبيع.
أهداف البحث: بيان حکم  المسائل المتعلقة بشرط کون المبيع طاهراً في الأدوية. وتقريب المسائل الفقهية المتعلقة بشروط المبيع للباحثين والمهتمين بالدراسات المالية المعاصرة.وإفادة اللجان الشرعية والهيئات في المؤسسات المالية الإسلامية بما هو جديد حول النوازل الفقهية المالية المعاصرة.
 
In light of technical progress and urbanization, convergence of societies, speed of transportation, ease of communication, diversified means of livelihood, and the multiplicity of ways of earning a livelihood, many jurisprudential issues appeared that were not undertaken in the eras of jurisprudential authorship from previous scholars, and some issues have changed in terms of their qualities and their belongings. Which calls for reconsideration according to these data and a statement of the Shariah  ruling therein. Although Islam has permitted selling as He - the Almighty said -:    And God permitted the sale and forbidden usury ﴾[Al-Baqarah: 275], but it has set conditions for it that the sale is not valid without being fulfilled. With regard to contracting parties, including those related to contracted matters, and scholars have previously explained these conditions with their evidence  And its rulings, and due to the presence of some contemporary calamities that scholars had not previously encountered, with the people's need to know their ruling, it is necessary to study and clarify them. I would have liked to participate in this chapter by researching its terminology (doctrinal issues related to the condition that what is sold is pure in medicines),
The importance of research :
 The occurrence of some Muslims who disagreed with the legitimacy of contemporary sales due to their ignorance of its ruling. And explaining the validity of the Shariah for every time and place, and that what is emerging from contemporary issues must have legal rulings. And the connection of the need of many Muslims to deal with some forms of sales in contemporary jurisprudential issues, and to contribute to the enrichment of jurisprudential studies related to contemporary calamities. And clarifying the calamities, the provisions related to them, because the research presents the rulings of contemporary jurisprudential imperatives in sales and links them to the sayings of the jurists on issues similar to them.
Reasons for choosing the research: The need to study contemporary calamities for their abundance and diversity. And my desire to research and participate in knowing the rulings of contemporary jurisprudential issues, especially with regard to the conditions of sale.
Research objectives: To clarify the ruling on issues related to the condition of pure medicine being sold. Bringing closer together the jurisprudential issues related to the terms of sale for researchers and those interested in contemporary financial studies, and informing the Shariah committees and bodies in Islamic financial institutions with what is new about contemporary financial juridical issues
