المستخلص

جاء البحث للتعريف بفکرة تصحيح القرار الإداري وحکمه في القانون الوضعي والفقه الإسلامي ومدى جواز رجعية القرارات المصححة، وشروط تصحيحها، والعيوب التي يلحقها التصحيح، وطرقه. وکان من أهداف البحث وضع تعريف دقيق لتصحيح القرار الإداري. والتساؤل حول الإلغاء الجزئي للقرار واعتباره طريقا ضمنيا لتصحيح القرار عن طريق القضاء الإداري. وتوضيح مدى معرفة الفقه الإسلامي لفکرة تصحيح التصرفات الفاسدة. وقد اتبعت الباحثة في بحثه المنهج الاستقرائي، والمنهج التطبيقي، والمنهج الاستدلالي. ومن نتائج البحث أن تصحيح القرار الإداري أحد وسائل معالجة بعض العيوب التي تلحق بالقرار الإداري، فتحوله من قرار غير مشروع إلى قرار مشروع تترتب عليه آثاره. وإن مبدأ عدم رجعية النص مبدأ دستوري واجب التطبيق، إلا أن الاعتبارات العملية أدت إلى وجود استثناءات على هذا المبدأ ومنها طبيعة تصحيح القرار الإداري. وأوصى البحث: بأهمية توعية رجال الإدارة بفکرة التصحيح کوسيلة لتجنب إلغاء القرار الإداري أو سحبه، ومعالجة القصور الذي لا يزال يشوب أبحاث القانون الإداري المقارن بالشريعة الإسلامية، وإلقاء الضوء من خلالها على القواعد الکلية وتطبيقاتها في مجال عمل القانون الإداري. 
The research was conducted to introduce the idea of correcting the administrative decision, its provisions in positive law and Islamic jurisprudence, the extent of the retroactivity of corrected decisions, the conditions for correcting them, the shortcomings of the correction, and its methods.The research also aimed at developing a precise definition of administrative decision correction. questioning the partial repeal of the decision and considering it an implicit way to correct the decision through the administrative judiciary. and clarify the knowledge of Islamic jurisprudence the idea of correcting corrupt behavior. In his research, the researcher followed the inductive, applied and evidentiary approaches. One of the results of the research is that the correction of the administrative decision is one way of addressing some of the defects of the administrative decision, transforming it from an illegal decision to a legitimate one with implications. The principle of non-retroactivity of the text was an applicable constitutional principle, but practical considerations had led to exceptions to that principle, including the nature of the administrative decision correction. The research recommended: It is important to raise awareness among administrative staff about the idea of correction as a means of avoiding the cancelation or withdrawal of administrative decision, and to address the shortcomings that still characterize research on administrative law in comparison with Islamic Sharia, and to shed light on the macro-rules and their application in the field of administrative law work.
