دية المرأة رؤية فقهية في ضوء النصوص والمقاصد الشرعية

المستخلص

يهدف هذا البحث إلى دراسة دية المرأة وموقف الفقه الإسلامي من مساواتها بالرجل أو استحقاقها نصف ديته، وقد اشتمل البحث على مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة. أما المبحث الأول فيتضمن العقوبات في الإسلام، مقاصدها، وخصائصها. وأما المبحث الثاني فيُعنى ببيان مقدار دية المرأة المسلمة. وأما المبحث الثالث فيتضمن دية المواطنة غير المسلمة. وأما الخاتمة: فقد توصلت فيها إلى جملة من النتائج، منها: أن الذي حدا بالفقهاء قديمًا على اعتبار دية المرأة نصف دية الرجل، وعدم ظهور آراء اجتهادية أو تجديدية في المسألة, كما ظهر في غيرها من المسائل أن قتل المرأة كان من النُدرة بمكان، وليس كعصرنا الذي يكثُر فيه قتل الخطأ في حوادث السير وغيرها، وتُصاب فيها المرأة كما يُصاب الرجل، فلم يكن هناك داعٍ لإثارة هذه المسألة في عصرهم. ومنها: أنه ليس للقائلين بالتنصيف دليل صحيح من السُنة، فكل أدلتهم من السُنة معتلة، ودعواهم الإجماع منقوض بوجود المُخالف المُعتبر. ومنها: أن القول بالتسوية بين الذكر والأنثى في الدية هو الأرجح؛ مراعاة لعموم الأدلة وقوتها، وعدم وجود مُخصص مُعتبر لها، وإعمالاً للمقاصد الشرعية. ومنها: ترجيح القول بأن دية المواطن غير المسلم كدية المسلم سواءً بسواء؛ أخذًا بمذهب الحنفية، وإعمالاً للمقاصد الشرعية، وتحقيقًا لمبدأ المواطنة. وقد أوصيت بعدة توصيات، منها: مطالبة الدوائر الدينية والفقهية في العالم الإسلامي بإبراز الرأي القائل بالمساواة بين الرجل والمرأة في الدية، والأخذ به، فهو رأي فقهي مُعتبر، يُناسب العصر الذي نعيش فيه، ويتوافق مع المقاصد الشرعية التي من أجلها شرع الله تعالى الديات. كما أوصيت المُشرع المصري باعتماد الرأي القائل بالمساواة بين جميع المواطنين ذكورًا كانوا أو إناثًا، مسلمين أو غير مسلمين، واعتبار دية المرأة في القانون المصري خاصة، والقوانين العربية عامة مساوية لدية الرجل، وعدم التفريق بينهما، خاصة مع كثرة الحوادث التي تودي بالمرأة، وتفقد فيها حياتها.
This research aims to study women's religion and the position of Islamic jurisprudence on their equality with men or their eligibility for half their religion. The research included an introduction, a preamble, three investigators, and a conclusion. The first involves punishments in Islam, their purposes, and their characteristics. The second research is concerned with the amount of blood money given to Muslim women. The third area of research involves citizenship for non-Muslims. In conclusion, I reached a number of conclusions, including: that the old scholars considered women's blood half of men's blood, and that there were no judgmental or innovative views on the matter, as it was shown in other matters that killing women was rare, and not like our age where there is a lot of accidental killing in traffic accidents and other accidents, where women are infected as men are, there was no reason to raise this issue in their time. Among them is that those who say that by classification are not correct proof of the Sunnis. All their evidence from the Sunnis is moderate, and their claim of unanimity is refuted by the presence of the violator. Among them: the male-female reconciliation in the blood is more likely to be said; Taking into account the general evidence, its strength, the lack of a significant allocation for it, and the application of Islamic purposes, including: It is more likely that the religion of a non-Muslim is the same as that of a Muslim; They took the doctrine of tap, and in fulfillment of Islamic purposes and in realization of the principle of citizenship. I have recommended several recommendations, including calling on religious and jurisprudential circles in the Islamic world to highlight and adopt the view that men and women are equal in religion. This is a considered jurisprudential opinion that is suitable for the age in which we live and is in accordance with the legitimate purposes for which God the Almighty prescribed religions. I also recommended that the Egyptian legislator adopt the opinion that all citizens, male and female, Muslim and non-Muslim, should be equal to each other, and that women's blood should be considered in Egyptian law in particular, and that Arab laws in general be equal to that of men, and that no distinction should be made between them, especially given the many incidents that harm women and cause them to lose their lives.
