الاتجار في المواقع الإليكترونية المؤثرة في الأمن الفكري

المستخلص

يهدف البحث إلى بيان موقف القانون الوضعي والفقه الإسلامي من الإتجار  بالمواقع الإليكترونية المؤثرة في الأمن الفكري، وبيان صور الإتجار وضوابطه، وإبراز الدور الفعال للأسر والدول تجاه المواقع الإليكترونية . وبيان اتفاق القانون الوضعي والفقه الإسلامي في تحريم الإتجار الغير المشروع بالمواقع الإليكترونية. ومدى عناية الإسلام بالفكر الإنساني وتوجيهه الوجهة السليمة على نحو لا نجد له نظير في أي أنظمة أخرى  ، وأن الأصل في الإنسان الفطرة السوية والاستعداد النفسي لاتباع كتاب الله تعالى وسنة رسوله صلى الله عليه وسلم ، ولكن الميل عن ذلك بسبب الوسط الاجتماعي الذي يعيش فيه الإنسان والمؤثرات الخارجية التي تحيد بالإنسان عن الطريق السليم، وفي مقدمة هذه المؤثرات (المواقع الإليكترونية). وينبغي أن يكون للدول العربية دورها في الحد من آثار المواقع الإليكترونية بسن القوانين والتشريعات التي تمنع ترويج هذه المواقع ووضع عقوبات رادعة لها ، ويجب على الدول أن تكرس جهودها لفرض الرقابة الفعالة من خلال  نظام شامل مدروس للحد من آثار هذه المواقع ، وواجب الباحثين المعنيين بدراسة مشكلات المجتمع البحث عن أنسب الحلول المناسبة للقضاء على الآثار السلبية لهذه المواقع ووضع الخطط المحكمة للتعامل معها،  وتوعية الشعوب والمجتمعات بأخطار هذه المواقع وإرشادهم إلى التمسك بكتاب الله وسنة رسوله صلى الله عليه وسلم وتوجيه الأسر للقيام بواجبها نحو أولادها من خلال وسائل الإعلام المسموعة والمرئية.
The research aims to clarify the position of positive law and Islamic jurisprudence on trafficking in electronic sites that affect intellectual security, and the images of trafficking and its controls, and to highlight the effective role of families and states towards electronic sites. It also aims to show the agreement of Islamic law and Islamic jurisprudence on the prohibition of illegal traffic in electronic sites. The extent to which Islam attaches importance to human thought and directs it in the right direction, which is not found in any other systems, and that the origin in man is the natural instinct and psychological readiness to follow the Book of God Almighty and the Sunna of His Messenger, May God Almighty. However, the tendency is due to the social milieu in which man lives, as well as external influences that deviate from the right path, foremost among them (electronic sites). Arab countries should play their role in limiting the effects of electronic sites by enacting laws and legislation that prevent the promotion of these sites and imposing deterrent sanctions against them. States should devote their efforts to imposing effective monitoring through a comprehensive and well-researched system to limit the effects of these sites. It is the duty of researchers involved in studying society's problems to search for the most suitable solutions to eliminate the negative effects of these sites and to develop precise plans to deal with them. It should also educate people and communities about the dangers of these sites and guide them to adhere to the Book of God and the Sunna of His Prophet, peace be upon God, and direct families to carry out their duties towards their children through audiovisual media.
