التطبيقات الأصولية والمقاصديةِّ في آية الدين Fundamentalist and Maqasidic Applications of the Ayat al-Dain

الحمد لله، والصلاة والسلام على الرحمة المهداة، وبعد....
فإن علم أصول الفقه هو المنهج الذي يتبعه المجتهد في تقرير الأحكام، وهو الضابط والميزان للاستنباط، وبه تظهر أسباب التباين والخلاف بين الفقهاء في تقرير الأحكام، ويأتي هذا البحث في سلسلة ضمن الأبحاث التي تسلط الضوء على الجانب الأصولي المرتبط بنصوص التشريع؛ حيث يعنى بالجانب التطبيقي العملي لآية الدين؛ التي اعتنت بمصالح المسلمين فيما يتعلق بالمعاملات المالية، حفظا للحقوق وصيانة للأموال؛ والتي تضمن عدم الجحود، وتنأى بهم عن النزاع، بما يضمن صلاح الدين والدنيا.
وقد وقفت فيه على كثير من المسائل الأصولية؛ التي كانت سندا للأحكام التي تخرجت عليها، مع الجمع بين عدة علوم شرعية. وقد قسمته إلى: مقدمة - شملت الهدف من البحث وأهميته والمنهج المتبع فيه – ومبحثين. تعرضت في الأول منهما للتعريف بالمصطلحات الخاصة بعنوان البحث، وخصائص آية الدين وفضائلها، وما تميزت به، وأهميتها، والموضوعات التي اشتملت عليها، وسبب نزولها. كما تعرضت في المبحث الثاني إلى التطبيقات الأصولية والمقاصدية المتعلقة بجزئيات آية الدين والمخرجة عليها، وذيلته بخاتمة تضمنت أهم نتائج البحث، ثم ذكرت التوصيات.

This research is part of a series of researches that shed light on the fundamental aspect related to the texts of the legislation; it deals with the practical application aspect of the Ayat al-Dain; which took care of the interests of Muslims regarding financial transactions, in order to protect rights and safeguard funds; which ensures the absence of ingratitude and distances them from conflict, ensuring the good of religion and worldly affairs. In it, I have identified many of the fundamentalist issues that were the basis for the rulings I graduated on, while combining several legal sciences. I divided it into: Introduction - including the aim and importance of the research and the methodology used in it - and two articles. In the first of them, I dealt with the definition of the terms related to the title of the research, the characteristics and virtues of the Ayat al-Dain, what distinguished it, its importance, the topics it included, and the reason for its revelation. In the second section, I dealt with the fundamentalist and Maqasidic applications related to the parts of the Ayat al-Din, and concluded with a conclusion that included the most important results of the research, followed by recommendations.
