لما كانت الفتوى أهم وسيلة لبيان حكم اللَّه تعالى في كل أمور الحياة، وكانت المصالح المرسلة من أكثر المصادر التي يعتمد عليها المجتهدون في الفتوى واستنباط الأحكام للمسائل التي لا نص فيها؛ رأيت أن أكتب بحثًا بعنوان :- "الفتاوى الشاذة المعاصرة المبنية على المصالح المتوهمة"؛ للكشف عن بعض الفتاوى الشاذة المبنية على مصالح متوهمة ليس لها وجود في الواقع، والتحذير من التسرع في الفتوى، وتوعية المجتمع بخطورة الفتوى بغير علم، واتبعت المنهج الاستقرائي والنقدي من خلال استقراء المادة العلمية المتعلقة بالفتوى، والمصالح المعتبرة، والمتوهمة، وقمت بتتبع بعض الفتاوى الشاذة المعاصرة في الإنترنت والقنوات الفضائية والإذاعات السمعية، وقمت بإفراد مبحث مستقل لها، وبيان المصلحة المتوهمة ومناقشتها مناقشة علمية موضوعية؛ لبيان فساد هذه الفتاوى؛ بسبب فساد ما بُنيت عليه من مصلحة متوهمة، ثم بيان الفتوى الصحيحة المبنية على أصل شرعي، وتوصلت إلى جملة من النتائج من أهمها: الضابط لحكم الإفتاء النظر إلى المصالح والمفاسد، والتشريع بالمصلحة المزعومة أو المتوهمة ذريعة ووسيلة إلى عكس مقصود الشرع، وأن التزام المفتي حِمى (لا أدري) عند عدم العلم لا يضع من قدره ولا يحط من شأنه، وذلك أن الإحاطة متعذرة، وأنه لا يجوز للمستفتي العمل بالفتوى الشاذة، ويجب على أهل العلم إبطالها وبيان الفتوى الصحيحة، وعلى المفتي أن يغير فتواه إذا تبين له أنها خطأ؛ لذا أوصي بمعاقبة الذين يفتون من غير أن تتوفر فيهم شروط الافتاء، ومطالبة كل من تجرأ على الفتوى بالدليل الشرعي، والعمل على تدريب خريجي الكليات الشرعية على الفتوى عن طريق الدروس العلمية والدورات المكثفة، والعمل على زيادة الطرق الموصلة للمفتين الأمناء، والمبادرة إلى إصدار فتاوى جماعية في النوازل التي تقع للأمة، لكي يكون الناس على بينة من أمرهم، ولا ينفرد أولئك الذين يفتون من غير علم بإصدار فتاوى لهذه النوازل.
Since the fatwa is the most important way to clarify the rule of God Almighty in all matters of life, and the interests sent are one of the most reliable sources on which the mujtahids rely in the fatwa and derive rulings for issues that are not stipulated, I thought to write a research entitled: - "Contemporary abnormal fatwas based on imagined interests", to reveal some abnormal fatwas based on imaginary interests that do not exist in reality, and to warn against rushing into the fatwa, and to educate society about the seriousness of the fatwa without knowledge, and I followed the inductive and critical approach from During the extrapolation of the scientific material related to the fatwa, and the interests considered, and imagined, and I followed some contemporary abnormal fatwas on the Internet, satellite channels and audio radios, and I singled out an independent study for them, and the statement of the imagined interest and discussed them objectively scientifically; What was built on it from an imagined interest, then the statement of the correct fatwa based on a legitimate origin, and reached a number of results, the most important of which are: the officer of the fatwa ruling looking at the interests and evils, and legislation with the alleged or imagined interest as a pretext and a means to reverse the intention of Sharia, and that the commitment of the mufti protected (I do not know) when not knowing does not put his value and does not degrade him, because the briefing is impossible, and that it is not permissible for the mufti to work with the abnormal fatwa, and the scholars must invalidate it and state the correct fatwa, Therefore, I recommend punishing those who issue fatwas without meeting the conditions for issuing fatwas, demanding that everyone who dares to issue a fatwa with Sharia evidence, work to train graduates of Sharia colleges on fatwa through scientific lessons and intensive courses, work to increase the roads leading to honest muftis, and initiate the issuance of collective fatwas in calamities that occur to the nation, so that people are aware of their matter, and those who do fatwas are not unique without He knew that fatwas had been issued for these calamities.
