خبر الواحد المخالف للأصول ومدى حجيته The news of the one who violates the rules and the extent of his authenticity

مسألة تقدير الدليل ووضعه في موضعه، وبيان أن رتبة الدليل مرعية عند الاستنباط أمر يجب ملاحظته والعناية به، فتفاوت الأدلة مسألة مسلّمة، فالتعامل مع خبر الواحد يجب أن تراعى فيه منزلته؛ ليدور بهذا في فلك ما علاه من مصادر التشريع، بحيث يظهر معاضدا ومظاهرا لما فوقه، واشتمل البحث على تمهيد ومبحثين وخاتمة: الأول: تناول خبر الواحد المخالف للمقطوع به، والثاني: تناول خبر الواحد المخالف للسنة المشهورة والقاعدة العامة واشتملت الخاتمة على أهم النتائج. فخبر الواحد المخالف للمقطوع يدور أمره بين التأويل السائغ إذا أمكن أو القول بالنسخ إذا كان محتملا أو الرد إذا لم يتأت فيه ما سبق. وقد ينظر إلى مخالفة خبر الواحد للقرآن أو السنة المشهورة أو القاعدة العامة على أنها بين عام وخاص أو ظاهر محتمل ونص، فيعود بنا الأمر إلى القواعد المتعلقة بالعام وتخصيصه، والخلاف فيها، والنسخ وأحكامه، وكون الزيادة على النص من قبيل النسخ أو البيان، فيبني كل فريق على ما تقرر عنده وترجح لديه.لكن لا يخفى أن الاهتمام بنقد المتن لا يقل في الأهمية والعناية عن أهمية النقد من جهة السند. فكلاهما متمم للآخر ومحقق للحفاظ على السنة. وقد اعتمدت في ذلك منهج محققي الأصول، القائم على التوسط والاعتدال والذي به نتجنب الإفراط والتفريط.
