يهدف البحث إلى تناول نازلة معاصرة، وهي: تجميد البييضات قبل الزواج والأحكام الفقهية المتعلقة بها، وفيه مقدمة، وتمهيد، ومبحثان، وخاتمة. المبحث الأول: يتناول تجميد البييضات قبل الزواج من منظور طبي. المبحث الثاني: يتضمن الأحكام الفقهية المتعلقة بتجميد البييضات قبل الزواج. والخاتمة: توصلت فيها إلى نتائج، منها: أن المقصود بتجميد البييضات: سحب البييضات من المبيض، وحفظها بواسطة التجميد. وأن فكرة تجميد البييضات تُعد حلاً عمليًا لبعض المشكلات التي تواجه المرأة التي تأخر زواجها. وأن الدوافع تتعدد للإقدام عليها قبل الزواج، فمنها دوافع طبية، ودوافع اجتماعية، ودوافع مالية. وأن هناك عدة مخاطر طبية ومجتمعية مُترتبة على عملية تجميد البييضات قبل الزواج. وأن الفقهاء متفقون على حرمة تجميد البييضات إذا كان الغرض من التجميد هو بيعها، أو هبتها، أو عرضها للابتذال، بينما اختلفوا في حكم تجميد البييضات قبل الزواج على رأيين، فمنهم من قال بالمنع، ومنهم من قال بالجواز، وقد اخترت مسلكًا وسطًا، فرأيت جوازه في حالات الضرورة، وعدم جوازه فيما عداها. وأنه يجوز لصاحبة البييضات المُجمدة أن تطلب من المركز القائم على عملية التجميد إتلاف بييضاتها دون حرج. وأن الفقهاء اختلفوا في حكم الاستفادة بالبييضات المجمدة قبل التخصيب في البحوث العلمية والطبية. وقد أوصيت بعدة توصيات، منها: أن على رجال الطب والفقه والقانون ضرورة وضع تصور شامل لهذه القضية، ودراسة كافة جوانبها، والوصول إلى رأي شرعي لهذه القضية المُستجدة من خلال الاجتهاد الجماعي المتمثل في المجامع الفقهية المختلفة، وبيان ما يحل وما يحرم. أوصيت الدوائر الصحية بتشديد الرقابة والمتابعة على المراكز القائمة بهذه العمليات، وضرورة تكثيف الإرشادات الخاصة بها، وتوعية السيدات بالمخاطر المحتملة من إجرائها، والبدائل المتاحة لهن في الوصول إلى حلم الإنجاب والأمومة. والمنهج المتبع في البحث هو: المنهج التحليلي، والمنهج المقارن.
The research aims to address a contemporary catarrh, namely: freezing eggs before marriage and the jurisprudential provisions related to them, and it has an introduction, a preface, two sections, and a conclusion. The first topic: deals with freezing eggs before marriage from a medical perspective. The second topic: includes jurisprudential provisions related to freezing eggs before marriage. Conclusion: I reached results, including: that what is meant by freezing eggs: withdrawing eggs from the ovary, and preserving them by freezing. The idea of freezing eggs is a practical solution to some of the problems facing women whose marriage is delayed. And that the motives are many to do before marriage, including medical motives, social motives, and financial motives. There are several medical and societal risks resulting from the process of freezing eggs before marriage. And that the jurists agree on the sanctity of freezing eggs if the purpose of freezing is to sell them, or donate them, or offer them to vulgarity, while they differed in the ruling In the ruling on freezing eggs before marriage on two opinions, some of them said prohibition, and some of them said permissibility, and I chose a middle path, and I saw that it is permissible in cases of necessity, and it is not permissible otherwise. The owner of frozen eggs may request the centre in charge of the freezing process to destroy her eggs without embarrassment. And that the jurists differed in the ruling on benefiting from frozen eggs before fertilization in scientific and medical research. I have recommended several recommendations, including: that the men of medicine, jurisprudence and law should develop a comprehensive vision of this issue, study all its aspects, and reach a legitimate opinion on this emerging issue through collective jurisprudence represented by the various jurisprudence councils, and explain what is permissible and what is forbidden. I recommended that the health departments tighten control and follow-up on the centers that carry out these operations, and the need to intensify their guidelines, and to educate women about the potential risks of performing them, and the alternatives available to them in reaching the dream of childbearing and motherhood. The research method is: the analytical method, and the comparative method.
