حديث الغامدية دراسة مقاصدية فقهية The hadith of Al-Ghamidiyyah - a jurisprudential intentional study

يتناول البحث أحد الأحاديث النبوية بالدراسة والتحليل، حيث يتناول حديث الغامدية وما يشتمل عليه من نكات وفوائد مقاصدية فقهية، وجعلت عنوانه: «حديث الغامدية- دراسة مقاصدية فقهية»، وهدفت منه بيان ما اشتمل عليه الحديث من مقاصد التشريع الإسلامي كحفظ النفس والعرض، وما اشتمل عليه كذلك من مسائل فقهية كان سند الفقهاء في استنباط أحكامهم.
وقد تناولته في مقدمة وثلاثة مباحث؛ فالمقدمة ذكرت فيها أسباب اختيار الموضوع وأهميته وإشكاليته وأهدافه والدراسات السابقة عليه ومنهجه وخطته، ثم تناولت المبحث الأول وبينت فيه لفظ حديث الغامدية وتخريجه من كتب السنة، وفي المبحث الثاني ذكرت المقاصد الشرعية التي اشتمل عليها الحديث، ثم تناولت في المبحث الثالث المسائل الفقهية المستنبطة من حديث الغامدية.
ثم ختمت بخاتمة بينت فيها أهم ما توصلت إليه من نتائج، ثم ذكرت بعض التوصيات، ومن النتائج التي توصلتُ إليها التأكيد على أن الشريعة الإسلامية بأحكامها المفصلة في كافة جوانب الحياة، تنظم شئون الناس وترسم لهم الطريق في حياتهم، لذا فإنه من الممكن أن تبرز قانونًا تُسيِّر به الدولة شئون حياتها وتسوس به أفراد مجتمعاتها، وأن حديث الغامدية ترسيخًا لمقاصد الشريعة الإسلامية من حفظ النفس والنسل والدين وغيرها، كما أنه مستند العلماء في كثير من القضايا الفقهية.
The research deals with one of the hadiths of the Prophet study and analysis, where it deals with the hadith of Al-Ghamidiyyah and what it contains of jokes and benefits of jurisprudential purposes, and made its title: «Hadith Al-Ghamidiyyah - a study intentional jurisprudence», and aimed at showing what was included in the hadith of the purposes of Islamic legislation such as self-preservation and presentation, and what it also included of jurisprudential issues was the support of jurists in deriving their rulings. The introduction mentioned the reasons for choosing the subject, its importance, problem, objectives, previous studies, methodology and plan, then dealt with the first section and showed the word hadith Al-Ghamidia and its graduation from the books of the Sunnah, and in the second section mentioned the purposes of legitimacy included in the hadith, and then dealt with in the third section jurisprudential issues deduced from the hadith of Al-Ghamidiya.  Then she concluded with a conclusion in which she showed the most important findings, and then mentioned some recommendations, and one of her findings is to emphasize that Islamic law, with its detailed provisions in all aspects of life, regulates people's affairs and charts the way for them In their lives, so it is possible to highlight a law by which the state manages its life affairs and decays by the members of its communities, and that the hadith of Al-Ghamidiyya is a consolidation of the purposes of Islamic law of preserving the soul, offspring, religion and others, as it is the basis of scholars in many jurisprudential issues.
