يناقش هذا البحث مدى تأثير ركن الشكل على صحة القرار الإداري، باعتباره أحد أركان القرار الإداري، فإذا تجاهلت السلطة الإدارية ركن الشكل أو لم تراعِ الإشكال أو الإجراءات المنصوص عليها في القانون فتصبح قراراتها معيبة بعيب الشكل، ويكون القرار الإداري قابلا للإلغاء.
وقد خلصت الدراسة إلى تباين الأحكام الصادرة المتعلقة بركن الشكل، حيث إن القضاء ينظر في كل حالة على حدة.
وقد أبرزت الدراسة جملة من النتائج أهمها عدم تدخل المشرع بالنص الصريح على ما يعد من الأشكال الجوهرية التي يترتب البطلان على عدم مراعاتها، وبين الأشكال الثانوية التي يجوز للسلطة الإدارية تصحيحها أو تغطيتها لاحقا على إصدار القرار، ولا يترتب البطلان على عدم مراعاتها.
كما خلصت الدراسة إلى أهمية الاهتمام بركن الشكل باعتباره أحد أركان القرار الإداري، وذلك من أجل حمل السلطة الإدارية على احترام مبدأ المشروعية باعتباره أحد ركائز قيام دولة القانون.
This research discusses the extent to which the form element affects the validity of the administrative decision, as one of the pillars of the administrative decision, if the administrative authority ignores the form corner or does not take into account the problem or procedures stipulated in the law, its decisions become defective with the defect of form, and the administrative decision is subject to cancellation. The study concluded that the rulings issued on the form element varied, as the judiciary considers each case separately. The study highlighted a number of results, the most important of which is the lack of intervention of the legislator by explicitly stipulating what is considered one of the essential forms that result in invalidity due to non-observance, and between the secondary forms that the administrative authority may correct or cover later on the issuance of the decision, and the invalidity does not result from non-observance. The study also concluded the importance of paying attention to the element of form as one of the pillars of the administrative decision, in order to get the administrative authority to respect the principle of legality as one of the pillars of the establishment of the rule of law.
