كان من اللطف الرباني بالخلق كافة استيعاب الشريعة الإسلامية لكثير من الأصول - وعلى رأسها القياس - التي أسهمت بدورها في إيجاد أحكام المستجدات والوقائع، فخرجت من حيز التنظير إلى حيز التطبيق، وكانت بمنزلة حائط صد منيع أبطل القول بجمود الشريعة وتحجرها، وعدم صلاحيتها لكل ما يستجد من حوادث الزمن وتطوراته؛ لذا أردت البحث عن ماهية القياس الأولوي، ومدى أثره في النوازل المعاصرة، وجاء بحثي تحت عنوان: "قِيَاسُ الأَوْلَى وَأَثَرُه فِي النَوَازِلِ المُعَاصِرَة"، بهدف الربط بين الأصول وما يستجد من وقائع لتنال حكمها في الشريعة الإسلامية؛ لأن النصوص محصورة، والوقائع لا تتناهى، ولو لم يعمل القياس لأفضى إلى خلو كثير من المستجدات عن الأحكام، فكان لزاما الوقوف على ماهيته، ومسمياته، وحجيته، ودلالته، ونوع الخلاف فيها، وبيان أثره في النوازل المعاصرة –سحب عينات الدم، البصمة الوراثية، وسائل تنظيم النسل، الكي الكهربي، الأدوية النفسية - ووجه الأولوية فيها، والحث بدوره على فتح باب البحث والدراسة لكثير من الوقائع والحكم عليها؛ لحث الخلق على قبولها، والعمل بمقتضاها.
as the kindness of the divine for his creations to intake all legislation of Islam for many fundamentals – one on the top that contribute in this role to figure out provisions of new events and facts so it appeared to be out of theoretical to the extent of applications, so it is considered as a wall preventing the sayings of Sharia freezing and stoning and the non- compliance to tis pure completion for all new events and facts of times and developments therefore I have endeavored to set identifications for the aprioristic scale and the extent of its effects in the contemporary ascending so this dissertation was identified under the title : the Aprioristic Scale and its effects in the contemporary descending to tie among the fundamentals and what facts are to acquire in its provisions of Islamic Sharia , because the texts are restricted of facts have endless , as if the scale will not work out that will be free from many facts and events of provisions, so it is mandatory to step up for its identifications and clarifications and reasoning and evidences and to show the types of differences and to state the effects in the contemporary descending - such taking Blood sampling - DNA fingerprinting - Family planning methods - Electro cautery - Psychotropic medications and the shapes of aprioristic and to emerge the roles to open new direction for more studies and researches for many facts and the provision on them to emerge the creation to accept them and act upon them
