تعد الأنشطة الفضائية من المجالات الحديثة التي تثير العديد من التحديات القانونية، خاصة فيما يتعلق بالمسؤولية القانونية والقانون الواجب التطبيق على النزاعات الناشئة عنها. في ظل التطور السريع لصناعة الفضاء وزيادة عدد الفاعلين الدوليين من دول وشركات خاصة، أصبح من الضروري وضع إطار قانوني واضح يحدد نطاق المسؤولية القانونية وآليات تسوية المنازعات.
يتناول هذا البحث الإطار القانوني الحاكم للمسؤولية عن الأنشطة الفضائية وفقاً للاتفاقيات الدولية، مثل معاهدة الفضاء الخارجي لعام 1967 واتفاقية المسؤولية لعام 1972، بالإضافة إلى التشريعات الوطنية ذات الصلة. كما يناقش البحث مدى كفاية هذه القواعد في مواجهة التحديات القانونية المستجدة، مثل عمليات إطلاق الأقمار الصناعية التجارية والتعدين الفضائي.
عبر دراسة تحليلية مقارنة، يقيم البحث مدى فعالية القواعد الحالية، ويستعرض الحاجة إلى تطوير تشريعات دولية أكثر شمولاً لضمان تحقيق العدالة القانونية وتعزيز التعاون الدولي في مجال الفضاء. كما يقترح البحث بعض الحلول القانونية التي يمكن تبنيها لمواكبة التطورات التكنولوجية الحديثة في هذا المجال.
 
Space activities have raised significant legal challenges, particularly concerning liability issues and the applicable law governing disputes arising from such activities. With the rapid advancements in space technology and the increasing involvement of international actors, including both states and private corporations, there is a pressing need for a well-defined legal framework regulating space liability and dispute resolution mechanisms .
This study examines the legal framework governing liability for space activities under international agreements, such as the 1967 Outer Space Treaty and the 1972 Liability Convention, alongside relevant national legislations. It evaluates the adequacy of these legal instruments in addressing emerging legal challenges, including commercial satellite launches and space mining operations.
Through a comparative legal analysis, this research assesses the effectiveness of existing regulations and explores the need for more comprehensive international legislation to ensure legal certainty and enhance global cooperation in space law. Additionally, the study proposes legal solutions to address contemporary technological developments in space-related activities.
