حوکمة الشرکات الوقفية دراسة فقهية تطبيقية تأصيلية

يقدم هذا البحث دراسة فقهية تأصيلية لموضوع حوکمة الشرکات الوقفية، إن تطبيق الحوکمة على الشرکات الوقفية يؤدي إلى ارتفاع مستوى الانتاجية والربح، ويساعد على التوصل إلى النتائج المرجوة، کما أن دراسة الحوکمة يعتبر مدخل لتطوير الشرکة الوقفية، وقد تناولت حقيقة الشرکة الوقفية وأرکانها ومشروعيتها من خلال توضيح مشروعية وقف النقود، ومشروعية استثمار الوقف في الفصل الأول، ثم تناولت في الفصل الثاني حوکمة الشرکات الوقفية، مفهومها وأهميتها، وأهدافها، وموقف الشريعة منها، ومدى توافقها مع الشرکة الوقفية، وبينت الحوکمة من خلال تطبيق الأصول المحاسبية على موجودات الشرکة الوقفية، وخصائصها وآليات تطبيقها، وذلک وفق منهج استقرائي للکتب والمقالات والبحوث إضافة إلى المنهج التحليلي والاستنباطي، وتوصلت إلى نتائج أهمها أن حوکمة الشرکات الوقفية يتماشى مع أحکام الشريعة الإسلامية ومبادئها السامية لما في ذلک من حفظ الحقوق، وإتقان العمل، وتحقيق النتائج المرجوة من الشرکة الوقفية ، وأن أساس الحوکمة في الشريعة الإسلامية مجموعة مبادئ ضمن أحکام المعاملات المالية، کما يمکن تأصيل حوکمة الشرکات الوقفية من الناحية الشرعية، من خلال ربطها بنظام الحسبة المقرر ضمن أحکام الشريعة الإسلامية، لما بينهما من توافق في العمل الرقابي التوجيهي للمجتمع، کما أنني وضعت عدة توصيات من أهمها العمل على استمرار وتنمية التأصيل للجوانب الفکرية لحوکمة الشرکات الوقفية، حتى نحصل على صورة متکاملة لحوکمة الشرکات الوقفية

This research presents an original jurisprudential study on the issue of endowment corporate governance. The application of corporate governance to endowment companies leads to a high level of productivity and profit, and helps to reach the desired results. The study of governance is an entrance to the development of the endowment company. To the analytical and deductive approach, and I reached results, the most important of which is that the corporate governance of endowment companies is in line with the provisions of Islamic Shariah and its lofty principles, as that includes preserving rights, mastering work, achieving the desired results of the endowment company, and that the basis of governance in Islamic law is a set of principles within the provisions of financial transactions, The corporate governance of endowment companies can also be rooted from the Shariah point of view, by linking them to the calculation system established within the provisions of Islamic Shariah, because of the compatibility between them in the supervisory work that directs the society. I also made several recommendations, the most important of which is working on the continuation and development of the intellectual aspects of corporate governance of the endowment, until We get an integrated picture of the endowment corporate governance.
